"An extreme case of misclassification ...
"An extreme case of misclassification would be for a construction company, for example, to treat someone that was picking up shingles off the ground and putting them in a Dumpster as an independent contractor," said Lon E. Siel, legal counsel with New Hampshire Employment Security.
"The purpose of doing that would be you would avoid various payroll taxes and the cost of workers' compensation insurance," he
said reports to the Department of Employment Security from the Internal Revenue Service relating to issuance of Form 1099s, the statement given to independent contractors instead of the W-2 given to employees, are a new enforcement tool.
"If an employer was reporting 20 employees and issuing 20 W-2s ... and then suddenly they're issuing two W-2s and 18 1099s, we get a report of that and that can direct our investigative efforts," he
