Required by Civil Service Law, a Section 75 hearing was conducted and hearing officer John Trela found Birch guilty of three of the five allegations against her. The county, after continuing to pay Birchs salary during her 18-month suspension, officially fired her in May.

Hearing Officer John Trela issued a determination as a result of those hearings, finding Birch guilty of failing to remove a probation officer from a case in which her life had been threatened by a probationer, for allowing that probation officer to continue to work on the case - and more specifically to write a pre-sentence investigation report on that probationer - and creating an environment in which that probation officer violated regulations that require impartiality and fairness in the investigative and reporting process.
Trela found that the seriousness of those charges warranted a termination from employment.
In his written findings, Trela validated his recommendation by saying Birch failed to, "accept responsibility, and to show remorse, for your actions, which implicated officer safety and further reflected your mismanagement of a situation, giving rise to an actual or apparent conflict of interest."

Prior to the hearing Wednesday, hearing officer John Trela said after the hearings are ended he will submit all transcripts and supporting materials to Madison County officials.
Following that, the county will take whatever action it deems necessary based on Trela's recommendation, Trela said.
Trela said from that point, a Freedom of Information Law (FOIL) request can be made for the transcripts.
The Oneida Daily Dispatch will submit a FOIL request.
Final briefings, which are similar to closing arguments, will be submitted by both sides by early March, with Trela providing his recommendations shortly after.
