In Green Bay ex-county GOP chair Donald Fleischman had been scheduled to enter a guilty plea to lesser charges in his escapades with under aged teenage runaways September 17 but Brown County Deputy District Attorney John Luetscher told Circuit Court Judge Donald Zuidmulder that the plea deal had fallen apart.
"We won't be able to settle the case and I don't think either side is going to give in," Luetscher said. The judge then set Fleischman's case for a November 24 jury trial.

The charges filed by Brown County Deputy District Attorney John Luetscher are identical to those presented last September but dismissed October 29 after the DA's sole witness, now 17, failed to appear.
Luetscher told the Green Bay Press-Gazette that he re-filed his case after contacting the boy. "I have a little more confidence that I'll be able to bring the complainant forward as a witness," Luetscher said.

An administrative judge will hear the case, he said. In the meantime, he said, The Learning Years is allowed to remain open during the appeals process. "She's still in business but we're not paying her," Luetscher said.
