Greg Campbell, the former controller of the embattled New Mexico Finance Authority, and John Duff, its current chief operating officer, were arrested, each on several counts of fraud and racketeering.
John Duff, the current chief operating officer for NMFA, has been charged as an accessory on eight counts of securities fraud and racketeering. Duff, who was the immediate supervisor of Campbell, also has been charged with allegedly conspiring to engage in a pattern of racketeering activity by fraudulently misrepresenting the financial statements of the NMFA to ratings agencies, investors, bond buyers, and the State of New Mexico, according to the criminal complaint.
Campbell and Duff were booked into Santa Fe County Jail and are subject to a $20,000 cash or surety bond.

SANTA FE - A grand jury has declined to indict John Duff, chief operating officer of the New Mexico Finance Authority, the agency that produced and distributed a fraudulent audit this year.
Duff, 70, was suspended without pay after being arrested in August on suspicion of securities fraud.
He could not be reached immediately for comment regarding the grand jury's decision.
The board of the finance authority considered firing Duff when it met Sept. 10, but it decided to take no action regarding his employment status.

A possible lawsuit by May against the NMFA may be strengthened by the fact that last week a grand jury in Santa Fe refused to indict the authority's chief operating officer, John T. Duff, who was arrested at NMFA offices on August 8.
At the time of the arrest, in the words of Securities Division chief Daniel Tanaka, Duff had "cooked the books" and collaborated with controller Greg Campbell in forging financial information.
While Duff was cleared by the grand jury last week, Campbell was indicted on 12 felony charges.
Duff also says he's considering suing the state.
"This thing, I think, was a very badly flawed prosecutorial effort based on misunderstandings and half-understandings," the 70-year-old Duff told Dan Boyd of the Albuquerque Journal, adding that "serious damage to my reputation occurred."
The board has placed Duff on leave without pay from the NMFA.

While the grand jury refused to indict suspended COO John T. Duff, former NMFA controller Greg Campbell was indicted on eight counts of securities fraud and four counts of forgery.
Originally, Campbell was also charged with conspiracy but those charges were dropped after the grand jury based in Santa Fe declined to indict Duff.
We have reached out to Duff for comment. If he gets back to us, we'll post his reaction. Update 9/22: Duff told Dan Boyd of the Albuquerque Journalthat the case against him was a rush to judgment.
"I'm a positive and optimistic guy and life will go," Duff told the Journal. "But serious damage to my reputation occurred ... The damage is never going to exactly go away."
Duff and Campbell were arrested back on August 8 and booked in Santa Fe, accusing them of submitting a forged audit, misrepresenting financial statements and trying to cover up $40 million in losses.
Duff has been a longtime employee at the NMFA where he's held a number of positions, including that of chief executive of the authority for a time. By all indications, Duff is now cleared of any and all criminal charges.
On the day Duff was arrested, the NMFA board put him on unpaid leave. It remains unclear if Duff will go back to the authority in any capacity.

The board met for nearly an hour and a half in a private, executive session closed to the public and the media in which members discussed whether to let go of May as well as former NMFA chief operations officers John Duff, who was arrested last month and is charged with taking part in the fake audit.
