In a story on the front page of today’s issue of The Pilot, SCC President John Dempsey has all but dared the state to try to make him enforce the new law’s provisions. Chief among those is the requirement that individuals must use public restrooms that correspond with the gender listed on their birth certificates. The law also wipes out all local anti-discrimination policies and replaces them with a statewide policy that specifically leaves out protections related to sexual orientation.
Dempsey, the wildly popular president now going on his 27th year in office, calls the law “a heavy-handed way to correct a problem that doesn’t exist.�

Dempsey, a Vietnam War veteran who has never run from a principled fight, said that the college has long had policies in place that ensure the safety, respect and understanding for LGBT students â€" and that it’s not about to change now.
“We have a system in place that has worked for 27 years, and we have no intention of changing it,� he said. “I’m certainly not going to hire 300 bathroom managers to make sure this law is being followed.� He basically dared the state to make him comply, declaring, “I can always quit.�

I wonder if the Pilot sought Dr. Dempsey's comments or did he offer them at his request. It is one thing if he was asked the question in the course of the Pilot's editorial but completely different if the fine Dr. decided to promote his flaunting of NC law. How does the Pilot or Dr. Dempsey justify their position that certain laws are bad and can be ignored while others are good, worthy of implementation? What might be the next law Dr. Dempsey decides to dismiss? How would he treat students who decided to ignore SCC policies or procedures? Does his position grant him the singular power to determine what laws to obey?

The principled thing for Dempsey to do would have been to say we have had no bathroom problems at SCC and we do not intend to have any.

Mr Dempsey is the President of Sandhills Community College not its dictator for life. The Pilot calls Mr Dempsey’s acts “courageous�, when in fact; his actions are lawless, endanger the well being and safety of the students under his charge and set the stage for massive civil liability for himself, the SCC Board of Trustees, Sandhills Community College and the taxpayers of NC.
As a public employee, Mr Dempsey is required to follow the laws of North Carolina and as the President of SCC, he is specifically charged with ensuring that they are enforced. Exactly what gives Mr Dempsey the authority to flaunt NC law? The correct term for public authorities who are above the law is “dictator� and we don’t allow dictators in the United States of America. The moment he stated he would violate NC law, Mr Dempsey should have been fired. As the President of SCC, Mr Dempsey has a fiduciary and legal responsibility to ensure the well being of the students who attend SCC, some of whom are minors. Mr Dempsey is endangering the lives of the boys and girls put into his charge. It is a very real possibility that a child molester, rapist of other pervert will use SCC’s status as a “Sanctuary Campus� to stalk and expose themselves to, molest or rape a child. When a tragedy like this occurs, Mr Dempsey’s intentional and very public disregard for NC law make him, the board of trustees (who failed their responsibility to reign in a lawless president), SCC and the state of NC itself liable when the inevitable civil lawsuit is filed. Mr Dempsey should resign (or, as he calls it “just quit�).
