has served as legal counsel to numerous banks and other lenders and to trustees in ESOP transactions.Mr. Cresto
is a member of the ESOP Association, and is a member of its National Finance Committee.Mr. Cresto
is also a member of the National Center for Employee Ownership.Mr. Cresto
has regularly made presentations regarding ESOPs and ESOP financing at seminars, including annual national conventions of the ESOP Association and National Center for Employee Ownership.He
also regularly speaks at programs sponsored by local financial institutions.
Financial Services.Mr. Cresto
regularly counsels financial institutions in the structuring and documentation of financing transactions.In addition to those services, he
has extensive experience representing financial institutions in work-outs and collection litigation.Mr. Cresto
has successfully defended lender liability lawsuits on behalf of Chicago area financial institutions.He
has provided counsel to insurance companies in connection with director and officer liability concerning financing matters.Mr. Cresto
is a contributor to McBride Baker & Coles' Lender's Alert and is a member of the Financial Services Department of McBride Baker & Coles.
Real Estate.Mr. Cresto
has extensive experience in representing residential and commercial real estate developers in the acquisition, development, and disposition of real estate.He
has represented publicly traded real estate investment trusts in the acquisition and disposition of commercial properties, and has counseled them in connection with their financing needs.
Civil Litigation.Mr. Cresto's experience in litigation dates back to his
career as an Assistant States Attorney in DuPage County, Illinois.Mr. Cresto
has tried dozens of jury trials to a verdict and has been involved in high-profile litigation matters, including death penalty murder cases.
is the author of numerous articles regarding ESOPs, including Anticipating and Avoiding ESOP Financing Obstacles for The Journal of Employee Ownership Law and Finance (Summer 1999).
Professional Affiliations and Education.Mr. Cresto
was admitted to the Illinois bar in 1983 and the U.S. District Court, Northern District of Illinois in 1987.He
undergraduate degree from Western Illinois University in 1977 and his
law degree from the John Marshall Law School in 1983.He
is a member of the Illinois Bankers Association, DuPage County and Illinois State Bar Associations, and the Federal Trial Bar for Northern District of Illinois.Prior to joining McBride Baker & Coles, Mr. Cresto
was an Assistant States Attorney for DuPage County, Illinois.
