A June 3 court order by U.S. District Judge John T. Nixon requires the school board to pay attorney's fees of about $14,433 and other legal costs of about $386 to the plaintiffs, La Vergne High School Principal Melvin Daniels and outgoing Kittrell School Principal Joe Herbert, who will become adult- education coordinator for the district.In addition to attorney's fee and other costs, Herbert accepted a $22,500 settlement, and Daniels agreed to a $20,000 arrangement, according to March 15 case records.Herbert, after being contacted by phone Friday, declined to comment about the litigation.Phone messages were left for Daniels Thursday and Friday, but he was unavailable for comment.Herbert served as principal at Kittrell School for nearly 15 years, but recently accepted a post to serve as coordinator of adult education beginning July 15.Herbert and Daniels competed against Gill when the three were among a group of 10 applying for board appointment as district director in spring of 2003.A few months prior to that, Herbert and Daniels applied for the principal posts at Siegel High and Oakland High.Both plaintiffs are making more per year in their new posts, although Herbert will make less per day.He will be making about $317 per day for 236 days of work in his new job.His K-8 principal's pay would have been about $323 per day for 210 days of work after counting a 2 percent increase.

Joe Herbert to leaveKittrell School Principal Joe Herbert will leave the K-8 campus after nearly 15 years to become Rutherford County's coordinator of adult education.Herbert asked to work in the city.Herbert will be going from a 220-day contract that paid $66,544 to a 260-day contract that will pay a projected $74,696 if a 2 percent raise is approved for district employees in 2005-06, Evans said.Herbert had 10 days of the 220-day contract off for the holidays as a principal, and he'll have 24 days off of his current contract as the coordinator of adult education.Herbert said during a Wednesday phone interview that he considered his new post to be a promotion."It's just a change in gear," Herbert said."I have been working for years with at-risk students, and now I will be working with at-risk adults.In addition to the report card results, Herbert encountered some criticism from parents at board meetings concerning school discipline and his punishment decisions.Past Kittrell Parent Alumni Community Club President Terri Neely acknowledged that there were a lot of issues with Herbert.Herbert had spent 21 years of career at Kittrell.After graduating from Fisk University in Nashville in 1971, Herbert taught at the school here for six years in physical education, science and social studies classes, and served as the basketball coach for girls and boys.He then spent 12 years as an assistant principal at Riverdale High before returning to Kittrell as principal October 1990."I will always consider Kittrell to be home," said Herbert, who also earned master's and education specialist's degrees from MTSU."I've had some very good experiences at Kittrell.I will be leaving behind a very competent faculty and staff who will be more than willing to work with parents and students and most importantly with the new administration coming on."While at Kittrell, Herbert launched an academic incentive that rewarded students in grades 4-8 for their report card progress with an A being worth $3, a B worth $2 and a C worth $1 for every grading period.The students could earn up to about $520 that would go to a college or technical school fund, and they'd collect it after earning a high school diploma."The program was set up to help young people to be employable," Herbert said.One of the goals in his new post will be to work with the Rutherford County Chamber of Commerce and local businesses in establishing incentives for employees to earn high school diplomas or the equivalent GED (General Educational Development) certificates, Herbert said.Another goal will be to provide a job placement service for the adult education students."I am very excited to take on this new adventure," Herbert said.Herbert in recent years has competed for other jobs in the district, including high school principal and system director.A black administrator, Herbert also filed a racial discrimination lawsuit against school officials Dec. 29, 2003, on the grounds that he was passed up for promotion to serve as a high school principal in a district that had no minorities or women in that position at the time.
