Dulles Transit Partners spokesman Howard N. Menaker called the safety tests "an ongoing conversation" among the contractor, the FTA and the Metropolitan Washington Airports Authority, which is overseeing the construction.
"It's never a matter of some hard-and-fast position of a contractor," he said. Neither Hamilton, the airports authority spokeswoman, nor Menaker, the spokesman for Dulles Transit Partners, was familiar with the discrepancy.

Howard Menaker, a Dulles Transit Partners spokesman, said that he could not speak specifically about the lack of investment in the rail project but said that all public-private ventures evolve differently.He also said that although he wasn't familiar with the specifics of the public-private partnership, such arrangements help companies protect fee structures and business strategies that would be valuable to competitors. "This is the level of confidentiality that the legislature felt was appropriate at the time they passed the public-private partnership act," Menaker said."I'm not going to second-guess the legislature."

Still, DTP's communications and outreach spokesperson Howard Menaker remains baffled by the agency's apparent shift in position."Seeing how the project has proceeded so far, we don't understand the FTA's eleventh-hour decision to raise issues in areas where they've already granted approval," he said, citing the agency's previous endorsement of MWAA as the project's funding grantee, plus the $140 million of federal funding that has already been invested in planning and preliminary design.Yet even with the looming uncertainty, Menaker remains optimistic."Given a close examination of issues and the Governor's expected response to the FTA, we're optimistic that the project will move forward," he says.

The next six months of work along this one-mile corridor up to the Dulles Toll Road will be "fairly intense," says Howard Menaker, communications manager for Dulles Transit Partners, the Metropolitan Washington Airports Authority's contractor for this phase of the rail project.
