Planning Director Eric Riel said pushing the second reading of the rewrite back into the new year would allow the his staff to answer new questions brought up at the meeting and incorporate final changes while also giving time to schedule an additional Planning and Zoning meeting next month if needed.
responded to the commissioner that the current Zoning Code did not specifically set the distance at 100 ft. - although he
acknowledged that the distance was interpreted from existing code - and that the new code put in a reduced distance to help developers meet more parking requirements and additional landscaping provisions.
challenged the assertion saying that other factors played a larger role in determining what developers would build.
acknowledged that both properties would be losing permitted uses in the new Zoning Map which is part of the new Zoning Code, he
said current uses were still allowed as non-conforming uses.
Eventually, the commission directed Riel
to reevaluate the new map to address certain properties and report back to them before final approval, although they did not specify that any action be taken.
