Eric T. Fingerhut, Counsel Eric Fingerhut, counsel in the trademark and Internet practice group, counsels clients on trademark and other intellectual property issues. His experience includes rendering availability and registrability opinions, procuring and protecting trademark rights, and working on foreign and domestic inter partes registration proceedings and infringement litigation. Mr. Fingerhut is extensively involved in domain name dispute resolution and the reformation of the domain name system in general. Mr. Fingerhut is a frequent speaker and author on intellectual property issues involving the Internet and is recognized by the World Intellectual Property Law Organization as an expert in this area. He is an active member of the District of Columbia Bar. Twice elected member to the D.C. Bar's Intellectual Property Law Section Steering Committee, he is currently serving his third consecutive year as co-chair of that committee. Fingerhut, an attorney with Shaw Pittman's Intellectual Property Group provided information on how to protect products, logos, and brand names under patent and trademark laws.His presentation, titled "Brand Matters," discussed the basics of branding, trademarks, domain names copyright and patents.He also discussed brand creation, legal clearance, U.S. and non-U.S. trademark protection, domain name issues, brand enforcement and protection, and brand building.The presentation closed with quick "rules to remember," including: 1) reserving a domain name does not amount to a legal right to use it, 2) the more arbitrary the mark, the broader the scope of protection, 3) conduct a trademark search, 4) seek federal registration, 5) international trademark protection is very important, 6) watch the representations, warranties and indemnities, 7) cybersquatting is stupid and potentially expensive, 8) domain registrants are bound by ICANN Uniform Dispute Resolution Policy, 9) be watchful of unauthorized framing and deep linking, and 10) pick and choose your battles.Eric can be reached at 703.770.7971 or eric.fingerhut@shawpittman.com.

He covered the legal particulars, including their relationship to elements like urls, and made it clear that a brand is worth protecting because it is, "the sum of a company's marketing position and performance. Amazon. com, according to Fingerhut, would have had little recourse against Amazon.gr, which claimed to be "the biggest bookstore in Greece" and even copied Amazon.com's look and feel, except for one thing. For some reason, Amazon.gr incorporated itself in Delaware, making it a US company subject to US laws.
