No criminal charges will be filed by the state in the death of former Venice High School student Elijah Carpenter. A Venice teen-ager was facing two counts of culpable negligence manslaughter in the death of Carpenter and a Davie, Fla., woman. Carpenter, a VHS athlete and drama student, was killed Aug. 5, 2001, when he was struck by a car on Interstate 75 at approximately 1 a.m. Whyte's two-page memo declining prosecution states that Carpenter and the Venice teen-ager went to a friend's house late Saturday, Aug. 4, where they prepared and consumed a tea made with mushrooms that Carpenter had picked in a field near his home. The memo states that Carpenter drank almost all of a large plastic cup of the concoction; the other teen drank only a small portion, the memo shows. At some point, Carpenter started behaving erratically. He said he saw demons and that the demons were pursuing him.He also said that he was a prophet and that he was dying, according to the memo. A few minutes later, the memo states, Carpenter started running into walls at full speed. Several people in the apartment tried unsuccessfully to control Carpenter. The teen-ager finally got Carpenter into his car and they left. The memo states that teen-ager had not driven far on Interstate 75 when Carpenter started opening and closing the passenger door to watch the dome light go on and off. At some point, Carpenter opened the door and jumped out of the moving car.It is not known how fast the teen-ager was driving when Carpenter jumped out. The Venice teen told investigators he stopped the car and looked in his rearview mirror but could not see Carpenter. He said he drove away because he was scared. Cruz told investigators that Carpenter was not running across the highway but appeared to be running straight at the car. Carpenter was killed on impact; Bourgouin died at Bon Secours Venice Hospital several hours after the accident.
