Court records show the district signed a stipulation for settlement to pay De Bruhl $33,000 after a formal mediation session in March. (Click here to read De Bruhl's complaint.)
De Bruhl served as assistant superintendent of educational services for more than three years before the district fired her "without cause" in February 2010.
Because her contract included a buyout provision, like most top school administrators, the district paid De Bruhl the salary and benefits left on her contract, for a total of $81,254, according to payment records provided by district officials.
Then in September - a month before she was elected to the school board - De Bruhl filed the wrongful termination lawsuit accusing the district of firing her out of retaliation. She says she suffered severe emotional distress because she was harassed and discriminated against while working for VVUHSD because she was black.
The lawsuit states that in October 2008 De Bruhl complained formally about "the need for salary parity and equity for her position ..."
De Bruhl was making $134,307 annually plus benefits in 2008 and Calderon, who joined VVUHSD nine months before De Bruhl, was making $142,365 plus benefits, according to district documents. The lawsuit also claims De Bruhl was unfairly and publicly criticized by Marilou Ryder, who served as superintendent from July 2009 to November.
The only written performance evaluation for De Bruhl was a "very positive" review by former Superintendent Julian Weaver in 2007, the lawsuit states.
De Bruhl alleges someone removed or destroyed the evaluation from her personnel file.
De Bruhl further claims her reports of the mistreatment to other administrators, including current Superintendent Elvin Momon, went uninvestigated.
Word had been spreading that De Bruhl was conspiring to get elected and then fire Ryder, a claim she adamantly denied.
De Bruhl also declined to comment on any of the lawsuit's details. She said the litigation has not affected her role as a board member.
"It was an employment lawsuit so it has nothing to do with the board position whatsoever," she said.
The new motion filed April 22 by De Bruhl's attorney states VVUHSD counsel had prepared a settlement agreement that was 10 pages long and "did not conform" to the agreement during mediation. De Bruhl's counsel has prepared a three-page agreement that the district has not accepted.
The initial mediation agreement, dated March 7, would result in the case being dismissed with prejudice, exempt the district from admitting any guilt and prohibit De Bruhl from seeking reemployment with the district (excluding her role as board member).
Regardless of the frivolous claims made by both the defendant and plaintive - if the district intended to terminate Bruhl - HR should have had its documentation "for cause" lock and cocked if even if the termination provision were deemed amiable at termination - the fact she was given the opportunity to file a lawsuit at a latter date and the fact that the district agreed to pay a sum that they have since reneged upon (according to DP and it was a binding agreement) these events certainly would indicate a lack of sophistication or poor advice resulting in creating gapping hole (vulnerability) to the district's assets. Ms Bruhl - instead of pursuing the lawsuit - albeit you allegedly have been wronged - your service to your community and those that voted for you would expect you in your present capacity to improve the HR policies in the district instead of furthering the turmoil, time and legal resources defending the district.
