The 8-year-old public records case former Mesa Mayor Donna Zink filed against the city is headed back to Franklin County Superior Court -- again.
The state Court of Appeals sent the case back to Superior Court to determine exactly how much the city of Mesa should pay Zink in public records penalties.
The decision was issued Tuesday. It's the third time the Court of Appeals heard the case. Both Zink and Mesa appealed the case, Zink asking for additional penalties and Mesa asking that mitigating factors such as the city's limited resources, culpability and all the circumstances of the case be considered when determining the award.
Donna Zink, a former Mesa mayor, sued the city for withholding public documents she requested and won in 2008 when a visiting judge in Franklin County Superior Court found that city officials had improperly withheld documents in 40 record requests.
Mesa's Donna Zink said her city messed up in not providing routine public records that she sought.
