David Horowitz, Director, Office of Compliance, FDA CDER, gave an update on current status, future plans and upcoming announcements on FDA's drug GMP initiative at the joint FDA/PDA joint regulatory conference. Horowitz gave specific examples for topics such as "Encouraging best manufacturing practices", "Risk-based approaches", "Enhanced coordination", "Consistency",and "Predictability and international collaboration". "The quantity of nicotine could be potentially dangerous to a small child," FDA attorney David Horowitz said Thursday.
He urged smokers to switch to FDA-approved smoking-cessation products.The agency can't say for sure if the lollipops pose an immediate health risk to adult smokers, because they are made with a different form of nicotine than is found in nicotine gum, patches or other approved products.
Because the lollipop and lip balm nicotine has not been tested, it is illegal, the FDA said, and the Internet pharmacies have been wrongly dispensing it without a doctor's prescription.
The FDA gave the three pharmacies 15 days to tell the government they're stopping sales or risk further legal action.The pharmacies are Ashland Drugs in Ashland, Miss., Bird's Hill Pharmacy in Needham, Mass., and the Compounding Pharmacy in Aurora, Ill.

DAVID J. HOROWITZ is Deputy General Counsel at the U.S. Department of Health and Human Services. Prior to this, he served as the Assistant Commissioner for Policy and led the Office of Policy in the Office of the Commissioner at the Food and Drug Administration (FDA). Mr. Horowitz previously served as Deputy Associate Commissioner for Compliance Policy in FDA's Office of Regulatory Affairs (ORA) (2005 - 2008), where he served as principal advisor to the Associate Commissioner for Regulatory Affairs (ACRA) on policy development and implementation. Prior to that time, he served as Director of Compliance in FDA's Center for Drug Evaluation and Research (CDER). He began his career at FDA in the Office of the Chief Counsel, serving as Associate Chief Counsel for Enforcement and Associate Chief Counsel for Drugs. Mr. Horowitz earned a BA in Public Policy from Brown University and a JD from the University of Virginia.
