NEW BRUNSWICK, NJ - David H. Dugan, III received the New Jersey State Bar Association's (NJSBA) Amicus Curiae Award at the Association's Board of Trustees Meeting and Holiday Luncheon on December 12, 2008 at the New Jersey Law Center. He is an Evesham resident and attorney in Medford.
The award recognizes Mr. Dugan for his efforts in the case of Brundage v. Estate of Carambio, where the Court considered whether an attorney was obligated under the Rules of Professional Conduct to disclose to the Appellate Division the fact that another case was pending in the Appellate Division concerning the exact same issue, particularly when the attorney was involved in the other case. Mr. Dugan argued for the NJSBA that there was no such obligation and, in fact, the attorney was fulfilling his obligation of representing the best interest of his client. The Court agreed, although some dicta in the case may lead to future actions on this issue.
An NJSBA Member Emeritus, Mr. Dugan has been active in the Association since 1968. Currently, he serves as the Chair of both the Professional Responsibility and Unlawful Practice Committee, and the Ethics Diversionary Program. In addition, he is a Trustee member of South Jersey Legal Services where he formerly served as Executive Director.
A Yale Law School graduate, Mr. Dugan is a solo practitioner. His practice is limited to legal ethics as a consultant, expert witness and defense counsel for lawyers in disciplinary and bar admission matters.

David H. Dugan, III is a sole practitioner in Medford, New Jersey, where he limits his practice to legal ethics matters which includes providing ethics counsel to other lawyers, serving as an expert witness in legal malpractice and lawyer discipline cases, and representing lawyers who face disciplinary charges. He has also represented the New Jersey State Bar Association in amicus curiae cases before the New Jersey Supreme Court, including In re ACPE Opinion 697, 188 N.J. 549 (2006) and Brundage v. Estate of Carambio, 195 N.J. 575 (2008).
Mr. Dugan is Chair of the New Jersey State Bar Association's Professional Responsibility and Unlawful Practice Committee. He is the author of ICLE's annually revised Manual on Legal Ethics and served as a Special Ethics Master by appointment of the New Jersey Supreme Court from 1992-2001. He has moderated or presented at more than 100 ethics seminars for ICLE, the New Jersey Association for Justice and other organizations.
Mr. Dugan received his B.A. from Wheaton College and his LL.B. from Yale Law School.
