Curt Aikens, the Yuba County Water Agency General Manager commented following the lawsuit that"Western Water's lawsuit and claims for damages against YCWA were an extraordinary departure from what the parties agreed to more than two decades ago.

In Thursday's article "Yuba River relicensing: Big numbers, big project the statement" a statement was attributed to Curt Aikens, YCWA's General Manager.
That sentence said, "Like Aikens, Reedy said he didn't think the increased flows in the river would impact the supply of water for agriculture. Mr. Aikens did not say that increased flow requirements below Englebright Dam would not impact water supplies for irrigation. In fact, Aikens noted that the subject of increased flow requirements is a major issue in the relicensing process, and any higher flow requirements would impact agricultural water supplies.

A series of El Nino-driven storms has 2016 off to a wet start, but water conditions at Yuba County's Largest reservoir, New Bullards Bar, are still drier than a year ago, said Curt Aikens, general manager for the Yuba County Water Agency.

YCWA General Manager Curt Aikens called the report a "fair characterization" of the event.
"This event was very disappointing because quicker preventative operator action would have greatly reduced the impact," Aikens wrote in an email. The reduced flows only affected about three-fourths of a mile of the river, due to storm runoff entering from Deer Creek, downstream from Englebright Dam, Aikens said. Aikens said YCWA has changed procedures so the alternate bypass opens automatically in the future.
