The Educational Retirement Board has paid its former chairman, Bruce Malott, $125,000 to settle a civil lawsuit he filed to recover money for legal representation in lawsuits arising from a state investment scandal.

MALOTT: Says payment proves his integrity
Malott filed the lawsuit two years ago when the board refused to pay for his personal attorney fees based on an attorney general's opinion and because he was also represented by lawyers hired by the state.
The ERB oversees an $11 billion pension fund for more than 90,000 teachers and retired teachers.
In his lawsuit, Malott claimed his personal interests were not always the same as the board's. He said he required separate legal counsel and was entitled to it under state law.
"The attorney general's opinion stated clearly that I should not be reimbursed for my legal fees if I had done anything wrong, so this payment only demonstrates what I have said all along - that I have acted with integrity throughout my tenure at the ERB," Malott said.

Malott had also asked for reimbursement for hiring a public relations firm, but dropped that request before filing his lawsuit.
Malott was named as a defendant in five separate civil lawsuits that claimed investments by the State Investment Council and the Educational Retirement Board were steered to investment firms by placement agents with close ties to then-Gov.

In an odd twist to the allegations of "pay to play" in state government during the Bill Richardson administration, on Tuesday (Nov. 1) Malott, the former chairman of the New Mexico Educational Retirement Board (ERB), filed a civil lawsuit against former State Investment Council (SIC) officer Gary Bland, longtime Richardson supporter Anthony Correra and his son Marc, who shared in an estimated $22 million in placement fees involving the ERB's pension fund and SIC investments.
