Bridget Moran, deputy supervisor for aquatics and agency resources for the state Department of Natural Resources, which has jurisdiction over the harbor, said the department must enforce state regulations prohibiting boats from remaining on public property for longer than 30 days without authorization.

"We had been holding off on enforcing the trespass statute because we were negotiating in good faith with the city to move that community into a legal use," she said. "Now that that's not the direction the city is going, we have no recourse but to go ahead and enforce our trespass statute."
Moran couldn't say how soon any liveaboards might be evicted or what the process would be. Up until last week DNR assumed plans for the open-water marina would move ahead, she said. The council's decision came as a shock.
"I was surprised and disappointed," she said.

But Moran said council members seemed surprised at the meeting to learn what the costs for maintenance, sewage and garbage related to the marina would be.
"We had said all along that they have to prove that they're using appropriate sewage and disposal methods," she said.

The boat owners now have the option of paying the state $185 annually to store their boats in the harbor on state-owned mooring buoys, Moran said, but they could only stay onboard 30 consecutive days and not more than 90 days a year.

Moran said she'll be putting together a plan to enforce DNR regulations, since the council made it clear the city isn't willing to evict the livaboards.
"They didn't want to be in the business of evicting anybody at all, period," she said.
