For its part, a Gutierrez's counsel, Anacleto Diaz, said they were not surprised by the decision. Its members have repeatedly announced that its proceedings are purely a political exercise and not a judicial proceeding, he said in a statement.

"We're almost certain the House Justice Committee will vote for the impeachment and transmit that report to the House plenary, which will vote on whether or not the Articles of Impeachment will be transmitted to the Senate for trial, and that is where we hope we will be given time to face our accusers and prove the charges against us in 2 impeachment complaints are false and baseless," Diaz said. Despite repeated invitations, Diaz said he doesn't see the Ombudsman appearing before the House Justice Committee when it resumes its hearings next Tuesday. Diaz is dismayed at the Justice Committee's insistence on pushing thru with proceedings pending a final decision from the Supreme Court on their appeal to throw out the complaints. "We feel that the proceeding before the Committee on Justice is moving with indecent and precipitate haste," he said.
During the House justice committee hearing on Wednesday morning, her counsel Anacleto Diaz informed the members of the committee they would be submitting finally her reply to the allegations included in 2 separate complaints by Friday. "We would be participating [in the hearings]. We will file our answer ad cautelam, which means we are filing with extreme caution on the back of the filing of our motion for reconsideration before the Supreme Court," he said.
On the first day of the clarificatory hearings on the impeachment complaints on Wednesday, Gutierrez's counsel, lawyer Anacleto Diaz, said their camp will not "avoid or skirt the proceedings.

Anacleto Diaz, the legal counsel of Gutierrez, made the manifestation ahead of presentation of evidence on the first impeachment complaint against the Ombudsman on Wednesday morning.
"We will not skirt, avoid or delay the proceedings, even if we have a pending motion for reconsideration [before the Supreme Court]. We are going to participate in the proceedings and we would like to hear [the supposed evidence] and get copies of affidavits [of accusers of Gutierrez] so that we can come up with a counter-affidavit," Diaz told the House Committee on Justice headed by Rep.
Since Gutierrez did not attend Wednesday's proceedings, Diaz vouched for his client and cited the Ombudsman's prepared answers to the two impeachment complaints against her.
Gutierrez's accusers, he said, could only lay their hands on the answers by first furnishing the Ombudsman's camp the supposed evidence to be presented by the complainants.
"Once we file these answers, the [justice] committee members will be convinced that the [Ombudsman] did nothing wrong and that she will retire [next year] with honor, pride and respect that she and her family believe she deserves," Diaz added.
"The Ombudsman has been in the public service for 40 years, Your Honor, and before these impeachment complaints filed against her, she has had an unblemished record," Diaz said.
"In fact, if you look at all of the charges, they are not based on any act of corruption or graft. They are based on supposed omissions committed by the Ombudsman in the course of the performance of her functions," he added.
Diaz said that their answers to the complaints would "convince [lawmakers] that the charges against her are false and baseless."
"Never mind if we have a pending motion for reconsideration [asking the Supreme Court to stop the impeachment proceedings]. We are not waiving [our right to file answers to the complaints]," he added.

We know of the clamor from some lawmakers, but I would say we are afraid to ask for a Christmas furlough [this time] because our request for such last year was denied," Anacleto Diaz, the lawyer for Arroyo in her P366-million plunder case, told The Manila Times in a phone interview.
She is still looking at the merits of the furlough and she still has to talk to her family," Diaz said.
But even without a petition from Arroyo, it is within Sandiganbayan's power to grant her a Christmas furlough, Diaz said.
The court "can grant her furlough, even without a motion, if it deems such action would conform to justice, equity and fairness. This is because our courts are not only courts of law, but courts of equity as well," he said.
1-BAP Rep. Silvestre Bello 3rd, author of the House Resolution appealing to the Sandiganbayan to grant a furlough to Arroyo, agreed with Diaz.

Diaz countered that Arroyo has just been released after about eight months in detention for a poll fraud charge that was not backed by strong evidence.
"How do we repair, how do we restore those eight months? We are only asking that the proceedings be suspended in the meantime that the Ombudsman is resolving our motion for reconsideration," he said.
"We cannot be accused of delaying the proceeding. Where's the delay? We received the official copy of the Ombudsman's resolution only last July 20. We had until July 25 to file our MR and we filed it yesterday. We did not even ask for an extension of time," Diaz added.
