Earlier, lawyer Reynaldo "Rene" Depasucat, Sr. is planning to file the same charges against Gamboa on ground that the incumbent mayor is about to conclude his third and final term this coming July.
...Gamboa started as mayor of EB Magalona in 1998.
In 2001 elections, he
re-election bid against Depasucat's son, Reynaldo Jr., but he
wasn't able to assume immediately due to an election protest filed against him.Comelec
officially declared him winner only in August 2003.In 2004, he
ran again and defeated then acting mayor Romulo Rhoel Mogul.
In an interview over Bombo Radyo-Bacolod, Gamboa
expected the move of the Depasucats, but stressed that he
is ready to face the music.
"I've already sought legal opinion on this matter.So I am confident that the case has no bearing anymore," he
added in the same radio interview.

...EB MAGALONA Mayor Alfonso Gamboa will sue Negros Occidental Provincial Election supervisor Marsha Cordero for allegedly "unduly influencing the Election Board of Canvassers (EBC)."

received Monday an official copy of the Comelec en banc's resolution dismissing Depasucat's motion for reconsideration. He
presumed that everybody, including Depasucat and Cordero, received an official copy for the Municipal Board of Canvassers (MBC )to convene and proclaim the winner after seven days unless the Supreme Court issued a temporary restraining order. He
cited Section 18, Rule No. 18 of Comelec rules, which states that a decision or resolution of the en banc shall become final and executory after seven days from its promulgation unless retained by the Supreme Court. He
added that if the Comelec
failed to convene and proclaim the winner they will file contempt charges. He
again expressed disappointment on the Comelec
for allegedly delaying the proclamation.

EB Magalona Mayor Alfonso Gamboa is seeking the disbarment of former Commission on Elections commissioner Ralph Lantion for "grave abuse of authority" in delaying his proclamation as the winning mayor after the May 2001 election.
